General Terms and Conditions
for Passenger Transport via Ferry
1) DEFINITIONS
For these general terms and conditions of transport, the following definitions apply:
- Company and/or Carrier: Positano Jet s.r.l., tax code and VAT number 03322850656, based in Positano (SA), at Via del Brigantino 11, in p.l.r.p.t.;
- Passenger: The individual who has purchased a maritime transport ticket issued by the Carrier through its direct sales channels (ticket offices/website) and/or indirect sales channels (authorized agents) and/or who holds the corresponding travel ticket;
- Vessel and/or Ship: Any unit within the Positano Jet s.r.l. fleet, composed of fast units and ferry boats;
- Ticket: The travel document confirming the conclusion of the transport contract, or the passage ticket under Article 396 of the Navigation Code and EU Regulation 1177/2010;
- Baggage: Personal items ordinarily carried in suitcases, travel bags, boxes, and similar items for the passenger's personal use.
2) ASSUMPTION AND DESCRIPTION OF THE SERVICE
The Company guarantees maritime transport for passengers, baggage, and accompanying animals, from the departure port to the arrival port, as regulated by Articles 396 et seq. of the Navigation Code and EU Regulation No. 1177/2010, in compliance with these General Conditions of Transport, which the passenger acknowledges, accepts, and agrees to abide by upon purchasing the ticket.
In particular, Positano Jet operates maritime transport services including routes from Positano – Capri – Amalfi – Salerno – Sorrento – Naples – Castellammare.
The General Conditions of Transport can be found at the boarding stations, the Carrier's ticket offices, and are available for download from the website www.lucibello.it.
The General Conditions of Transport are subject to changes and updates to remain compliant with applicable regulations. The version available on the Company’s website (www.lucibello.it) is the definitive text to identify the content of the contract. In case of any modifications, the General Conditions of Transport applicable on the booking day will be applied to each order.
3)TICKETS
The ticket can be purchased:
- At the Carrier's ticket office and/or from authorized ticket agencies at the boarding ports;
- Online at www.lucibello.it;
- Through a cumulative request for tourist tours, a voucher will be issued to be presented at the Carrier’s ticket offices.
The ticket is personal and non-transferable. It must be kept for the entire journey and shown upon any request by the onboard staff or company officials responsible for controls.
According to Article 399 of the Navigation Code, a passenger boarding without a paper or electronic ticket (or subscription) must immediately notify the onboard staff, who will issue the travel document upon payment of the ticket price. Failure to notify will result in the passenger being required to pay double the ticket price to the port of destination, plus penalties as per Article 40, paragraph 4, of Campania Region Law No. 3 of 28.03.2002.
The Company, with inspectors, and staff on land or board, may conduct ticket checks at embarkation or during navigation. The passenger must cooperate with the staff responsible for the checks to facilitate the boarding process and present identification in case of a resident ticket.
The ticket is valid exclusively for the indicated trip.
Tickets with abrasions and/or corrections are considered invalid. The ticket not used by the indicated departure date will lose its validity with no right to refund. No duplicate tickets will be issued for lost or stolen tickets. The passenger is responsible for correctly providing the data during online booking. It is the passenger’s responsibility to immediately contact Positano Jet’s Contact Center if they have not received the ticket purchased online, or to verify the accuracy of the data provided.
4) PRICES AND RATES
The total price of the ticket consists of the fare plus any additional supplements, taxes, and port fees, the amounts of which are subject to change; as well as any pre-sale fees up to €1.50 per passenger and vehicle, and booking fees of €1.00 per leg.
The Company may apply the most commercially favorable tariff to it.
The rates applied by the Company include VAT, when applicable. For rates, please refer to the updated fare schedule of the Company available on the website www.lucibello.it, which is an integral part of these General Terms and Conditions of Transport.
For the transport of bicycles or similar bulky items, the fare refers to the updated fare schedule of the Company available on the website www.lucibello.it, which is an integral part of these General Terms and Conditions of Transport.
Children
Children under 2 are entitled to free travel without a seat; if they occupy a seat, the ticket must be paid at the applicable fare. For children aged 2 to 10, a reduced fare applies; once a child turns 10, they are required to pay the full fare. The child's age must always be documented and verified during ticket issuance and boarding. After ticket issuance, no reductions can be granted.
Passengers under 14 are not allowed to travel on Positano Jet vessels unless accompanied by an adult; they must be constantly supervised by the parents and/or adults responsible for them and cannot move around the ship unaccompanied. The Carrier will not be responsible for any damage to minors in violation of these conditions.
Minors aged 14 to 18 can travel alone, provided they have written authorization from the parent or legal guardian that releases the Carrier from all responsibility.
Residents in Departure Ports (Positano, Capri, Amalfi, Salerno, Sorrento, Naples, Castellammare)
Discounted rates for residents in the indicated ports apply exclusively to passengers who prove their residence with appropriate documentation to be presented to the ticketing staff for ticket issuance or at boarding, both on board and at the check-in desk. If the passenger fails to present the document granting the discount at the time of ticket issuance, they may certify their residence by completing the self-certification form, under Article 46 of Presidential Decree No. 445/2000, provided by the ticket office staff. The completed and signed self-certification form will be handed to the ticketing staff to allow for the verification as per Article 71 of Presidential Decree 445/2000. If the passenger fails to present the self-certification or valid documentation proving their residence, they will be required to pay the full fare. No refund will be given for resident tickets purchased without the necessary documentation; they will be confiscated and the administrative penalties as per Article 40, paragraph 4 of Campania Region Law No. 3/2002 will be applied, unless criminal conduct is also identified.
Invoice
Tickets do not serve as invoices. Passengers who require an invoice for the ticket must make an explicit request when purchasing the ticket by providing the necessary details for issuing the electronic invoice.
5) BAGGAGE
Baggage refers to suitcases, travel bags, trolleys, backpacks, and duffel bags containing the passenger's belongings. Passengers are allowed one free piece of baggage with maximum dimensions of 40x20x25 cm. Baggage is allowed on board only together with the passenger, who is responsible for its boarding.
Each passenger is also allowed to bring one piece of hand luggage with maximum dimensions of 50x40x20 cm, considered standard baggage. For baggage exceeding these dimensions or weighing more than 9 kg, an XL baggage ticket must be purchased. The passenger is responsible for ensuring baggage complies with the specified limits.
Passengers on board without an XL baggage ticket will be required to pay double the ticket price.
The price of the ticket does not include any fees for baggage handling services. Each passenger can bring their baggage to their assigned seat. If the baggage is too large to fit in the assigned seat, the passenger may, upon showing the XL baggage ticket, place it in areas indicated by the onboard staff. Baggage cannot be placed on chairs or in ways that obstruct other passengers.
Until disembarkation, passengers are responsible for their baggage and its contents. Positano Jet is not responsible for damage to passengers' baggage, as handling is at the passenger's risk.
In case of loss or damage to baggage or items, subject to verification of the Carrier's responsibility, the limits and conditions outlined in Articles 412 and 435 of the Navigation Code apply, up to €6.20 per kilogram, only in cases where the damage is immediately reported and verified by the onboard staff with the Captain's note in the ship's logbook. Failure to contest visible damage to baggage will result in the expiration of rights as per Articles 412, 435 of the Navigation Code and EC Regulation 392/2009.
In cases of invisible damage or loss of baggage, the passenger must submit a written complaint within fifteen days of disembarkation or delivery or the expected delivery date (Article 15, EC Regulation 392/2009).
The Company disclaims any responsibility for theft or loss of passengers' belongings or baggage left unattended aboard the vessels. However, even in cases where the Company is found liable, the flat-rate compensation will not exceed the limits set by EC Regulation 392/2009. Passengers may report losses to the company by contacting support@positanojet.it. Unattended baggage left aboard or in the embarkation area, which is not reclaimed by the rightful passenger, will be stored by the Company for a maximum period of 30 days.
6) PETS
Unless otherwise required by law, passengers may travel with dogs, cats, and other small domestic animals, provided they pay the applicable fare and comply with the following regulations:
- Dogs must be kept on a leash and wear a muzzle at all times. Cats and other small animals must be transported in appropriate cages.
- Food and water containers must have a secure lid to prevent spills.
- Guide dogs are transported free of charge.
The company reserves the right to deny boarding to animals that, due to specific characteristics (strong odor, health condition, hygiene, or aggressive behavior), may pose a nuisance or danger to other passengers.
The company assumes no responsibility for any damages that may occur during the journey. The passenger is liable for any damage the company may suffer due to the transport of pets without the necessary documentation.
7) CHECK-IN AND PASSENGER CONDUCT ON BOARD
Passengers must arrive at the boarding area with a valid ticket at least 15 minutes before departure. Boarding cannot be guaranteed for late arrivals.
Passengers who fail to board on time or do not board at all are not entitled to a refund, even partially. No reimbursement will be granted if the passenger does not arrive on time for boarding.
Passengers holding tickets purchased in advance must check for schedule changes beyond the company’s control by visiting www.lucibello.it.
For operational or safety reasons, departures may be moved up by ___ minutes without giving passengers grounds for complaints or compensation.
Passengers must follow all regulations regarding transit on the dock and boarding procedures, strictly adhering to posted instructions and maintaining a respectful and civil attitude toward fellow passengers, onboard staff, and dock personnel. Safety and hygiene rules must be observed at all times. Climbing over barriers, discarding objects on the ground, in the sea, or outside designated waste bins is strictly prohibited.
Passengers must follow boarding orders without skipping queues and comply with the instructions provided by dock personnel.
Failure to comply may result in warnings from authorized personnel at the boarding areas. If necessary, law enforcement will be called for immediate intervention.
From the moment of boarding until disembarkation, passengers must comply with all instructions given by the ship’s command. The company is not liable for any damages to passengers resulting from failure to observe these instructions.
Passengers must behave in a way that does not cause discomfort or harm to other travelers or crew members and does not compromise navigation safety.
In the event of an accident during transport or boarding/disembarkation operations, the passenger must immediately inform the ship’s command so that an official incident report can be drawn up. Failure to do so will result in the forfeiture of any compensation claims for accidents that were not officially recorded.
8) PASSENGERS WITH REDUCED MOBILITY
A person with reduced mobility is anyone who faces particular difficulties in using public transportation, including elderly passengers, individuals with disabilities, and pregnant women.
Passengers requiring special assistance must notify the company at least 48 hours before departure by providing documentation verifying their need. They can do so by calling +39 089 875326 or emailing support@positanojet.it. This allows the company to assess whether applicable safety regulations, the ship’s design, and port facilities can accommodate safe boarding, disembarkation, and travel.
Pregnant women who have completed the 6th month of pregnancy must carry a medical certificate authorizing travel, which must be presented upon request by onboard staff.
In cases of complicated pregnancies, a medical certificate authorizing travel is required regardless of the gestational month. The ship’s command has full discretion to deny boarding.
The company’s authorization to board should not be interpreted as a waiver of its right to later contest the passenger’s condition, whether known or unknown at the time of embarkation or departure.
The passengers will not be entitled to compensation for damages and will be held responsible for any harm caused to themselves, the vessel, its equipment, third parties, or third-party property.
9) GUARANTEES
The Company guarantees that it holds all necessary authorizations and licenses to operate the service.
The Company also guarantees its expertise and experience in the sector and that the service is conducted using properly maintained and suitable vessels.
The Company commits to providing passengers with a service that aligns with the descriptions on its website or any other official information issued by the Company.
10) PASSENGER RESPONSIBILITIES AND OBLIGATIONS
Passengers are liable for any damage caused directly by them, or by persons or animals in their custody, to the vessel, its furnishings, equipment, accessories, other passengers, luggage, crew members, or third parties. They are also responsible for any fines, penalties, or expenses incurred by the Company due to their actions.
Passengers must behave prudently and be aware of the inherent risks of navigation. They acknowledge that sea travel is subject to weather and sea conditions, which may cause unavoidable movements such as rolling and pitching, as well as humidity on both exterior and interior surfaces.
Passengers must follow all instructions from the ship’s command and the onboard signage, use handrails and support handles where necessary, and exercise caution at all times. The Company declines any liability for injuries or damages resulting from reckless behavior.
11) CANCELLATION, DELAYS, AND INTERRUPTION OF SERVICE
In cases provided by the Navigation Code, or due to objective necessity and/or force majeure, the carrier has the right to cancel a scheduled departure, modify the itinerary (adding or omitting stops) or change the departure port.
In case of departure delays, passengers are entitled to the rights of information and assistance outlined in Articles 16 and 17 of EU Regulation No. 1177/2010, as well as the protections of Article 18 of the same regulation, subject to the exemptions specified in Article 20.
For delays in arrival at the destination port, passengers—where applicable and except in cases exempted under Article 20 of the EU Regulation—are entitled to financial compensation as per Article 19.
The Captain has full authority to proceed without a pilot, tow or assist other vessels when necessary, and deviate from the planned route for any reason related to their official duties, in accordance with the Navigation Code and international conventions. The Captain may modify the vessel’s itinerary, even in the opposite direction or beyond the usual route, and transfer passengers to another vessel or alternative transport, whether owned by the carrier or not, to reach the destination port.
The carrier is not liable for delays, failure, or improper execution of the transport if caused by unforeseen events, force majeure, adverse weather or sea conditions, strikes, or technical failures considered force majeure. These exclusions are outlined in Articles 402, 403, 404, and 408 of the Navigation Code and Article 20 of EU Regulation No. 1177/2010.
The carrier is not responsible for delays due to port operations.
12) REFUNDS AND MODIFICATIONS
Refunds
Failure to board due to the passenger’s inability to travel results in the immediate termination of the contract.
According to Article 400 of the Navigation Code, no refund is due if the passenger does not notify the Company of the issue before departure.
However, the Company allows passengers to request a refund under the following conditions:
Cancellations up to 24 hours before departure → 20% of the ticket price will be withheld.
Cancellations up to one hour before departure → 50% of the ticket price will be withheld.
Booking fees are non-refundable.
No penalty applies if the Company cancels the departure.
Modifications
All tickets are valid only for the date, route, and time indicated. However, Positano Jet allows passengers to modify the date and/or time, subject to availability.
Online tickets can be modified at Positano Jet ticket offices or through the modification link on the Positano Jet website or travel document (https://positanojet.nefesy.com/mb2c/login). At the ticket office, changes can be made to departure time and date, except for Tour tickets, which can only have their date changed online.
Note: Partial modifications to a booking are not allowed.
Accredited agencies with account access can modify bookings directly through the B2B portal in the booking management section.
Online modifications must be made at least 2 hours before the scheduled departure.
Modification fees:
Changes requested up to 24 hours before departure → €5 per ticket.
Changes requested within 24 hours of departure → €10 per ticket.
Online changes can be made to departure time and date.
Additional charges may apply depending on ticket price differences (e.g., upgrading from a regional fare ticket to a full-fare ticket). If the new fare is lower, no refund will be issued for the price difference.
Group bookings cannot be modified online. Instead, passengers must contact the ticket office or the designated sales representative.
Changes made at the ticket office incur a €5 per person, per route fee and can be requested until the scheduled departure time.
13) COMPLAINTS
Passengers must immediately report any issues to onboard staff so that the Company can promptly address them.
For any concerns related to onboard accommodation, passengers should contact onboard personnel.
Passengers wishing to submit feedback, suggestions, or complaints may send them via certified email (PEC) to positanojet@pec.it. Complaints must include:
Full name and contact details.
A copy of the ticket or boarding pass.
A detailed description of the issue.
By submitting a complaint, the passenger expressly authorizes Positano Jet to process their data.
Compensation claims are individual. Complaints or claims on behalf of multiple passengers listed on the same ticket must be accompanied by a signed authorization from each individual.
In case of injury or damage to persons or property, passengers must immediately notify the ship’s command on the vessel where the incident occurred.
14) LIMITATION PERIOD
Any claims arising from the transport contract regarding passengers, luggage, or vehicles are subject to the statutory limitation periods outlined in Articles 418 and 438 of the Navigation Code.
15) APPLICABLE LAW AND JURISDICTION
This contract is governed and interpreted under Italian law.
For any disputes arising from this contract, the exclusive jurisdiction belongs to the court where the Company has its registered office.
However, if the passenger is a resident of Italy and qualifies as a consumer under Italian law, they may bring claims before the court in their place of residence or domicile.
